What is an SR-22?

An SR-22 is a form that’s filed with your state to prove that you have car insurance meeting the minimum coverages required by law. Also known as a “Certificate of Financial Responsibility,” “SR-22 Bond,” or “SR-22 Form,” an SR-22 isn’t a type of insurance but rather an easy-to-get document from your state’s department of motor vehicles.

Do I need an SR-22?

An SR-22 is ordered by a court or your state. If it’s court-ordered, the judge will let you know at the hearing. If it’s state-ordered, you’ll typically receive a letter from your state’s department (or bureau) of motor vehicles.

Not everyone needs an SR-22. It’s typically required if you’ve been caught driving without insurance or a valid license. Here are some other reasons you might need to file an SR-22 form:

SR-22 for drivers that do not own a vehicle can be filed with a “non-owners” policy.

If you do not own a motor vehicle, you must purchase a non-owners policy. Because, this policy provides liability to a vehicle you drive that you do not own. Non-owners policies typically are discounted. However, if you purchase a vehicle you must endorse your non-owners policy to an auto policy. This allows a driver to remain covered and legal to drive.

The SR-22 must be submitted from an insurance company licensed in the state for which the SR-22 is required. The insurance company must also has the authority or “power of attorney” to issue an SR-22. Our office maintains a listing of authorized companies.

An SR-22 requirement can be issued by the Secretary of State based on a judgement in a county court. Depending on the state you live in SR-22’s are usually required for 12-36 months. Some states require these to be consecutive months. In other words, if you are late on a payment you have to start the SR-22 all over. Some people view SR-22 insurance as high risk insurance. This is mostly because most insurance agents do not offer them.  Drivers may need one for several different reasons. For instance:

1. Driving an uninsured vehicle.

2. Unsatisfied judgement suspensions.

3. Driving with a suspended or revoked license.

4. Having an at-fault accident while driving uninsured.

5. Multiple moving violations or tickets within 12 months.

6. Being behind on traffic citation payments.

7. Being behind on child support payments.

8. Other major moving violations, such as reckless driving.

9. Driving under the influence. (DUI)

Keeping a SR-22 policy active is the key

Lapsing your policy will suspend your license. In other words, failing to pay your insurance by the due date. Some Insurance King clients opt to pay the 6-12 months of insurance premium in full to avoid suspensions. Other clients opt to pay 30 days in advance. Which ever payment plan you choose, make sure to pay before the payment is due to the insurance company. Because, this will help avoid driving on a suspended license. If you are ever unsure if your policy is active, you should contact your Secretary of State.

Insurance King will file the actual SR-22 form with your state for you. Prior to driving, you should always make sure the SR-22 is on file with the State. Once the SR-22 is filed, your license suspension will be removed. Hence making it legal to drive again.

Note: SR-22 filings are state specific. What is required in one state may not apply in another state.

Filing an SR-22 in a different state
Drivers needing an SR-22 that move to a different state will need to start a new policy in the state they reside. Insurance King has helped people in this situation. As long as the Insurance King writes in both of the states. Not too many agents are able to file SR-22’s in different states. Because, most agents are not licensed in multiple states.
Switching insurance companies with a SR-22 filing
It is possible to cancel an SR-22, in order to switch to another company. However, Insurance King suggests getting the new SR-22 on file before canceling the old policy. Because, the license will suspend for cancelling a policy. In other words, do not lapse a SR-22. The reason is that you will risk driving on a suspended license. This could also force you to start over on the time line for which you need a SR-22 with your state.
Completing a SR-22

Once the SR-22 or financial responsibility requirements have been satisfied. You will be notified, as will your insurance company. SR-22’s generally do not cost extra money. It’s primary function is to suspend your license if your policy lapses. Insurance King suggests you keep the letter of completion with your insurance card for a few months. Just to ensure you do not have any issues with any unforeseen traffic stops.
